Terms of Service

1. Introduction
Welcome to LawGo. These Terms of Service ("Terms") govern your access to and use of our legal practice management platform and related services (collectively, the "Service") provided by LawGo (Pty) Ltd ("we", "us", or "our"), a company registered in the Republic of South Africa.
By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.
2. Definitions
- "User" means any individual or entity that accesses or uses the Service.
- "Account" means your registered account to access the Service.
- "Personal Information" means information as defined in the Protection of Personal Information Act 4 of 2013 (POPIA).
- "Client Data" means any data, information, or content you upload, submit, or store using the Service.
3. Eligibility and Registration
To use our Service, you must be at least 18 years old and have the legal capacity to enter into binding contracts under South African law. By registering for an Account, you represent and warrant that all registration information you submit is truthful and accurate.
You are responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account.
4. Use of the Service
4.1 Permitted Use
The Service is provided for lawful legal practice management purposes only. You may use the Service to manage legal matters, client information, documents, and communications in accordance with applicable laws and professional regulations.
4.2 Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Violate any applicable laws, including the Legal Practice Act 28 of 2014
- Infringe upon the rights of others
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or servers
- Upload malicious software or harmful content
5. Data Protection and POPIA Compliance
We are committed to complying with the Protection of Personal Information Act 4 of 2013 (POPIA). Our collection, processing, and storage of Personal Information is governed by our Privacy Policy, which forms part of these Terms.
As a User processing Personal Information through our Service, you acknowledge that you are a "responsible party" under POPIA and are responsible for ensuring your use of the Service complies with POPIA and other applicable data protection laws.
6. Intellectual Property
The Service, including all content, features, and functionality, is owned by LawGo (Pty) Ltd and is protected by South African and international copyright, trademark, and other intellectual property laws.
You retain all rights to your Client Data. By using the Service, you grant us a limited license to host, store, and process your Client Data solely for the purpose of providing the Service.
7. Fees and Payment
Certain features of the Service may require payment of fees. All fees are quoted in South African Rand (ZAR) and are inclusive of Value Added Tax (VAT) where applicable. Payment terms will be specified at the time of purchase.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
THE SERVICE DOES NOT CONSTITUTE LEGAL ADVICE. YOU SHOULD NOT RELY ON THE SERVICE AS A SUBSTITUTE FOR PROFESSIONAL LEGAL ADVICE.
9. Limitation of Liability
To the maximum extent permitted by South African law, LawGo (Pty) Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.
Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amounts paid by you to us in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless LawGo (Pty) Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
11. Termination
We may suspend or terminate your access to the Service at any time for any reason, including breach of these Terms. Upon termination, you may request a copy of your Client Data in accordance with our data retention policies.
12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.
13. Consumer Protection Act
Nothing in these Terms is intended to limit any rights you may have under the Consumer Protection Act 68 of 2008 (CPA) where applicable. If any provision of these Terms conflicts with the CPA, the CPA shall prevail.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Effective Date". Your continued use of the Service after such changes constitutes acceptance of the modified Terms.
